按照中国刑法规定，走私、贩卖、运输、制造鸦片1000克以上、海洛因或甲基苯丙胺50克以上者，最高可被 判处死刑。尤其是走私和贩卖毒品1000克以上者，不论其国籍，大部分被判处死刑。

据韩国外交部介绍，北京市高级人民法院2014年12月16日通知韩国驻华大使馆对金某的死刑执行已获得最 高人民法院的批准。韩国政府鉴于金某带毒重量和之前被执行死刑的毒贩相比较少，且从韩中关系和人道主义角度 出发，多次要求中方免除金某死刑。但中方表示，毒品犯罪对社会危害较大，中国政府不管罪犯是本国公民还是外 国公民均予以严惩，决无例外。韩国外交部还表示，在金某被捕期间，外交部共对金某进行了23次领事面谈，并 安排家属会面，收管物品等，提供了各种领事协助。
